Terms & Conditions

A binding agreement between you and us governing your use of UNIQUE.

1. Acceptance and eligibility

UNIQUE (“the Service”) is operated by UNIQUE PREP ACADEMY (“we”, “us”, “our”). These Terms & Conditions form an electronic contract under the Information Technology Act, 2000 and the Indian Contract Act, 1872, and do not require physical signature. By registering for, accessing, or using the Service you accept these terms. If you do not agree, you must not use the Service. You must be competent to contract under Section 11 of the Indian Contract Act, 1872; if you are a minor, you may use the Service only through and with the consent of a parent or legal guardian, who shall be bound by these terms on your behalf.

2. Your account

You may sign in using a one-time password sent to your phone number, an email address and password, or a Google account. You are solely responsible for the security of your credentials and for all activity under your account. Accounts are personal to you: access is limited to one active device at a time, and signing in on a new device may end the session on the previous one. We may refuse registration, or suspend or reclaim an account, where we reasonably believe these terms have been breached. Notify us promptly of any unauthorised use.

3. Licence

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access the Service and its content solely for your own private study and examination preparation. No other right or licence is granted, whether by implication, estoppel, or otherwise. All rights not expressly granted are reserved.

4. Acceptable use

You must not, directly or indirectly:

Any breach of this clause entitles us to suspend or terminate your access immediately and without refund, and to pursue all remedies available under law, including the Copyright Act, 1957 and the Information Technology Act, 2000.

5. Premium and payments

Certain features require a paid Premium plan billed in Indian Rupees (₹). Prices, plan features, and plan durations may be revised prospectively at our discretion; revisions do not affect a term already paid for. Payments are processed by a third-party payment gateway; we do not store your full card details. Premium access is personal and non-transferable, and by purchasing you authorise the applicable charge. Cancellations and refunds are governed exclusively by our Refund & Cancellation Policy.

6. Intellectual property

The UNIQUE name, software, design, and the original selection, arrangement, classification, and frequency analysis of the question bank constitute our intellectual property, protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. Previous-year examination questions remain the property of their respective examining bodies and are reproduced solely for educational reference. See our Copyright & IP Notice.

7. No affiliation; educational aid only

UNIQUE is an independent study aid and is not affiliated with, endorsed by, or sponsored by Kerala University of Health Sciences (KUHS) or any examining body. The Service provides revision support only; it is not professional, academic, or medical advice. Please read our Disclaimer.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle your personal data under the Digital Personal Data Protection Act, 2023.

9. Disclaimer of warranties; limitation of liability

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, completeness, availability, or fitness for a particular purpose. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss, loss of data, or any loss arising from reliance on the content, including examination outcomes. Our total aggregate liability arising out of or in connection with the Service shall not exceed the fees paid by you to us in the three (3) months preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot be excluded under applicable law, including the Consumer Protection Act, 2019.

10. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the Service, or your violation of any law or third-party right.

11. Suspension and termination

We may suspend or terminate your access at our discretion, with or without notice, if you breach these terms or use the Service unlawfully; no refund is payable on termination for breach. You may stop using the Service and close your account at any time. Clauses relating to intellectual property, liability, indemnity, and governing law survive termination.

12. Changes to the Service and these terms

We may modify, add to, or discontinue any feature of the Service at any time. We may also update these terms; material changes are reflected by an updated “Last updated” date, and continued use after changes take effect constitutes acceptance.

13. Governing law and jurisdiction

These terms are governed by the laws of India. All disputes are subject to the exclusive jurisdiction of the courts at Kochi, Kerala, India.

14. General

These terms, together with the policies referenced above, are the entire agreement between you and us. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these terms; we may assign ours to a successor of the Service. We are not liable for delay or failure caused by events beyond our reasonable control.
